Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of AiHud's website, assistants, and related services (the "Service"), provided by AiHud (Ehud Ettun) ("AiHud", "we", "us"). By using the Service, starting a trial, or paying for a plan, you agree to these Terms. If you are using the Service on behalf of a business, you confirm you are authorized to bind that business.
2. What the Service is
AiHud provides AI-powered assistants that operate over messaging channels such as WhatsApp to help you handle customer messages, scheduling, and similar tasks. The assistant generates responses automatically using third-party AI models. Features, limits, and pricing may change over time as the Service evolves.
3. Trials and credits
We may offer trials that include a limited amount of usage "credits". Credits meter your usage of the Service and have no cash value, are non-transferable, and are not redeemable for money. We may change how credits are priced, granted, or consumed, and may expire unused credits or end a trial at any time. Trials and promotional credits are provided as-is with no guarantee of continued availability.
4. Payment and refunds
The Service is paid for by purchasing credits in advance through our payment providers (such as PayPal). You pay for credits at the time of purchase, and they are consumed as you use the Service. Unless required by law or stated otherwise in writing, all payments are final and non-refundable, and purchased credits have no cash value and are not redeemable for money. You are responsible for any taxes that apply to your purchase. If a payment fails or is reversed, we may suspend or terminate your access.
5. Acceptable use
You agree not to use the Service to: send spam or unsolicited bulk messages; break any law or third-party rights; send unlawful, deceptive, harassing, or harmful content; impersonate others; probe, attack, or attempt to disrupt or gain unauthorized access to the Service; resell or provide the Service to third parties except as expressly permitted; or use it in a way that could damage AiHud or its providers. We may suspend or terminate accounts that violate this section.
6. Your responsibilities and compliance
You are solely responsible for how you use the assistant and for the messages sent through your account. If you use AiHud to message your own customers or contacts, you are responsible for having a lawful basis and any required consent to message them, for honoring opt-outs, and for complying with all laws and platform rules that apply to you (including marketing, privacy, and consumer-protection rules). You are the controller of your customers' data; AiHud acts as your processor as described in our Privacy Policy. AiHud is a tool — you, not AiHud, are the sender of your messages.
7. AI output — no professional advice
The assistant produces automated output that can be inaccurate, incomplete, or inappropriate, and may "hallucinate" facts. Output is provided for your convenience and is not professional advice of any kind (legal, medical, financial, or otherwise). You are responsible for reviewing output before relying on or acting on it, and for any decisions you make based on it.
8. Third-party services
The Service relies on third parties, including messaging platforms (such as WhatsApp/Meta), AI model providers, hosting, and payment processors. AiHud is not affiliated with, endorsed by, or sponsored by these platforms. Your use of them is subject to their own terms, and they may change, limit, or discontinue access in ways outside our control. We are not responsible for outages, suspensions, or account actions taken by third-party platforms.
9. Service provided "as is"
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the assistant's output will be accurate or that the Service will meet your requirements.
10. Limitation of liability
To the maximum extent permitted by law, AiHud will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost data, or business interruption, arising out of or related to the Service — even if advised of the possibility. In no event will our total aggregate liability for any claim relating to the Service exceed the lesser of (a) the amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) US $100.
11. Indemnification
You agree to indemnify and hold harmless AiHud from any claims, damages, losses, and reasonable costs (including legal fees) arising from your use of the Service, the messages you send through it, your violation of these Terms, or your violation of any law or third-party right.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk. On termination, your right to use the Service ends; sections that by their nature should survive (including payment owed, disclaimers, liability limits, and indemnification) will survive.
13. Changes to these terms
We may update these Terms as the Service changes. We will post the updated version here with a new date, and continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and the competent courts of Israel will have exclusive jurisdiction over any dispute — except where mandatory consumer-protection law in your country of residence gives you additional rights that cannot be waived.
